Crow's Art Commissions

Payment:
Some notes regarding payment are also listed in the Terms of Service, outlined below.

• Paypal - USD - Invoice only (Protects us both!) - Minimum 1/2 payment up front. Final 1/2 will be required after finalized sketch.
• We'll discuss final quotes for your commission, regarding any possible additional fees and charges, before I send an invoice; Invoices do not have to be payed immediately, but work on a specific commission will not be started until that invoice is payed - Exceptions available on a case by case basis for repeat / regular clients.

Art Trades:
I am almost always open for art trades! These are really fun and I know that not everyone can afford a full price commission! If you're interested in inquiring about an art trade, please feel free to message me, and we can discuss!
Please note, art trades will be worked on after payed commissions unless you have already sent in your half - then it will be treated as a payed commission and worked on accordingly!

Hey! If I deny a trade with you, please don't take it personally! I might be busy, not in the right headspace for this type of trade, or I might just be into some very specific styles of art at the moment. It's not about your art style, it's about where my brain is at any random point in time! Your art is still beautiful, regardless of whether I want to do a trade at any given moment in time or not.

Terms of Service:

• Regardless of whether a client reads through any / all of my Terms of Service, if you commission me, you still agree to all of the terms listed here. Keep this in mind.
• I hold the right to deny any commission that comes my way for any reason.
  I hold the right to cut off any commission at any point during the process for any reason.
• Client will be alerted of both of the above decisions, should they be made; Refunds will be given as necessary.
  
  
  
• Commissions are to be used for personal use only; Commercial use is prohibited.
• My work, in any capacity and especially commissions, are NOT to be used for NFTs, Crypto / Blockchain / etc. or AI learning, generation, etc. TL;DR No Blockchain, Crypto, or AI use with my art.
  
  
  
• Payment is required up front before work begins on a commission or via discussed payment plan.
• Minimum 1/2 payment before work begins on a piece.
• Payment payed via Paypal invoice.
• Payment payed in USD.
  
  
  
• REFUNDS will only be given if I, the artist, cannot finish a client's piece and/or if I have not yet started on said piece.
• If a refund has been requested after I have started working on a piece, only half of the payment already given will be refunded.
• Please note that the refund amount will not be exact, given paypal fees.
  
  
  
• Expected turnaround / completion time will vary based on Commission type, Current queue length, Client correspondence response time, Real life issues / pop ups, among possible other possible factors. However, general turnaround time for Rendered Pieces is ~1 to 1.5 month(s), give or take; Sketch turn around times are at maximum one month, but usually shorter.
• If you’re curious as to where I am on your piece / how close I am to finishing it, feel free to either ask directly or check out my Trello!
• If there is a delay, issue with timeline, etc. for any reason, clients will be contacted.
  
  
  
• Commissions are worked on in a “First payed, first served” basis; If a client pays for their commission, even half, their spot is solidified immediately into my queue.
• If the client does not wish to pay for their commission until I get to their spot in the queue, prior to payment, and multiple people end up requesting and paying for their commissions before the original client does so, then those pieces will end up being worked on first.
• TL;DR Pay for your commission, even just a half payment, as quickly as possible and you won’t keep getting booted to the bottom of my work queue!
  
  
  
• Updates per commission sent when applicable based on desired commission type.
• Bobbles, Sketches, and Stickers will not receive in-progress updates unless requested by the client.
• Lined Render and Painted commissions will receive in progress updates at specified points, at random as I desire, or when specifically requested by the client.
  
  
  
• Client will receive a full resolution png image (Usually ~3500 x ~3500px @ 300dpi), as well as a small (~900 x ~900px) image.
  
  Watermark will be present on the image(s) given to client, please keep this in mind.
• Full resolution images and/or PSD files for client pieces may / may not be posted to my Patreon as tier rewards at my discretion.
• Images for client pieces may or may not be used as shop items* at my discretion.
  • If a client does not want their piece to possibly end up as a shop item, they need to disclose this during (not after) the commission process.
  • "Shop Items" include, but are not limited to, photo prints, stickers, mugs, clothing, etc. and other physical and/or digital items for sale.
  
  
  
• I hold the right to post and use these images as I, as the artist, see fit: This includes, but is not limited to, social media posts, portfolio showings, prints / products to be sold, etc. etc.
• Your commission piece will never be re-sold to someone else as a commission or anything! c:
• Client may remain anonymous where images are posted, if so desired. (IE, I won't tag or name the client)
  
  
  
• Client is allowed to repost the images where they desire so long as credit to artist is provided.
  
  This includes but is not limited to tagging and/or linking back to the artist on Patreon, KoFi, Tumblr, etc. etc.
  Yes, this also includes Discord! You don't have to link back to my socials (Though that would be appreciated) but a "Drawn by DarkCrowArt" is required.
  
  
  
• Copyright of the piece itself (not the character(s) within) remains mine, the artist, unless discussed on an individual basis with the client.
  • The client is not allowed to use commission pieces for commercial use (unless previously discussed and agreed upon with myself), which may include, but is not limited to:
    • Physical items such as photo prints, stickers, mugs, bags, etc. etc.
    • Digital items such as selling a view of the high quality art, selling stages of the art, NFTs, etc. etc.
  • The client IS allowed to sell the character within the art (assuming they own said character) with the value of their art piece(s) taken into account.
    • EX: If a client wishes to sell their original character, who’s entire gallery of art not including my pieces equals $200 in value, they are also allowed to sell the art I’ve made them of that character for the value of that piece or less.
      • So if the client commissioned a piece for $45 from me, the total would equal $245 or less.
      • A client may not add additional value to pieces of this form of sale unless they discuss it with me first.
  
  
  
• Time Constraints may incur additional fees (if I only have three days to complete a commission, for example, I may have to charge extra). The client needs to be apt and quick in responses if time constraints are to be met; If the client is unable to communicate in a timely manner, a lack of finished product in the given time constraint is not the fault of the artist.
  
  
  
• Commissions are to be used on a personal basis, not for commercial purposes.

Additional Charges and Fees:


Backgrounds:

• Basic Shape / Color or Color Gradient Background = Free
• Simple Background = +$10
• Complex Background = +$20

Additions:

• Additional Character / Large Animal: +100% base price per addition
• Small Animals: +%10 base price per addition
• Children / Babies?: +50% base price per addition
  Teenagers count as additional characters, not children / babies.
• Additional characters and animals or other may be subject to additional fees themselves. (Ex: Adding complex armor onto the extra character)

Complexity:

• Complex Clothing or Armor = Commission Dependent
• Complex Pose or Foreshortening = Commission Dependent

Complex poses and foreshortening will only be charged when requested by the client. If the artist adds a complex pose / foreshortening at their own discretion, the client will not be charged.


Changes and Overhauls:

• 5 Minor Changes per Stage = Free
• 6+ Minor Changes per Stage = Additional Charges
  
  Small Changes EX: Adding a small hair clip, a minor color change, Nose shape change, etc.
  
  
• 2 Major Changes per Stage = Free
• 3+ Major Changes per Stage = Additional Charges
  
  Major Changes EX: Pose overhaul, Moving a limb drastically, etc.
  
  
• 1 Complete Overhaul at Sketch Stage = Free
• 2+ Complete Overhauls at Sketch Stage = Additional Charges
• Complete Overhaul at Non-Sketch Stage = Additional Charges

Time Constraints:

• Client has the right to put forward time constraints on their piece (EX: Needing a piece finished by a specific date, like a birthday, by Christmas, etc. etc.); However, depending on the given timetable, extra fees may be incurred due to a "Rush Order" so to speak.
